Ruling on Coyotes move could come Wednesday - Boston Business Journal:

http://save-novablade.com/index.php?option=com_content&task=view&id=1&Itemid=1
U.S. Bankruptcy Court Judge Redfield Baum struggled to stay on taskat Tuesday’ws hearing as attorneys representingt Balsillie, Coyotes owner Jerry Moyes, the city of Glendale, the and otherf professional sports leagues deliveredx hours of oral arguments over bankruptcy anti-trust law, relocation and other legalk issues. Baum and the myriad of attorneys delved into obscure bankruptcy provisions and past relocations by teamzs including theOakland Raiders, San Diego Quebec Nordiques and Baltimore Colts.
Baum focusedd on whether Balsillie will have to pay the NHL a relocatiom fee on top ofhis $213 milliohn offer to buy the financially strapped Coyotesa from Phoenix trucking company owner Jerry Moyes. The relocation fee could total as muchas $100 court documents indicate. Baum appears readhy to rule that the NHL has the rights to the Hamiltonj market and if the Coyotes aremoved there, Balsillie will have to compensatew the league for loss of an expansio opportunity. The city of Glendale pressed Baum to consider legaol claims and costs that would accompany a move to That could offset an offer as lowas $140 million by partiea wanting to keep the team in city representatives said.
Glendale officials said they wouls make a claim for as muchas $500 million if the team breaks its lease at the city-owned Jobing.com Arena. Arena concessionaires Aramark Corp. also could make a claim. Moyesa and Balsillie’s attorneys arguefd that a lease claim is subjec t to various monetary caps and that the coury can discharge lease terms and penalties in ordee to maximizethe team’s value for Moyes said a decision coul come Wednesday and has urged the court to hold an auction sale for the hockey team on June 22. The NHL and Glendale say the sale should be put off until August and the league said it will finance the Coyotes into next season ifneed be.
Glendalee attorneys also pressed Baum to find out how much moneg Moyes may have taken out of the They point to the fact the Coyotes spend monety leasing private office space at Westgatwe City Center instead of usingarena offices. Moyes spokesman Steve Roman saidthe city’e speculation that Moyes is profitingy from that arrangement is false. Moyes and Westgatw developer Steve Ellman splitjoinft assets, including the Coyotes, in 2006 with Moyes taking over as team The Coyotes have lost more than $300 milliob since moving to Phoenix from Winnipeg in 1996.

San Antonio Business Journal: Tech & Innovation : Business Advice

zuloraxelewo.blogspot.com
Because that's what the idea was. I wouldc replace my home office telephone which I only use foroutgoing calls, and instea d start making all of my callx over the Internet. This way I could pocket the $50 a montg I've been giving to Verizoj and use those savings to buy more important Like … food. Except it really didn't turn out that way. Why? Becaus the Internet phone services I triedworked ... but just not all the Which is typical of most For example, I played arounr with Skype (www.skype.com) for a few Not bad.
Signing up for the service was free and the headsert that I purchased from Staplesfor $20 only had to be replaced once (I do not advisde lending one's headset to a 12 year old. Enoug said). Astonishingly, installing the Skype application on mylaptopp didn't cause it to lock up or crash on me. So for that reasonm alone I felt that thingxwere successful. Once up and running, Skype did as promised … just abou all of the time. I used the little computerf generated keypad on my laptopo tomake calls. If I called anothed Skype user the callwas free.
Unfortunately, I don't reallhy have a lot of conversations with high schoo andcollege kids, nor do I care to reallt speak to anyone under 25. So there'd not a lot of phone numbers in mySkype However, you can use Skype to call a regular land line and then get chargerd a few cents per So that's what I mostly did. The problem was the connection. It Most of the time. But sometimes it just didn't. Sometimea I had to call back the person two or threde times to get agood connection. Or spealk loudly. There were a few instances wherer I saidnaughty words.
Then theree was this one time whers I tried to participate in a conference call and had to make the threed other people wait whileI re-callexd the call-in number a few times until therew was no crackling sound on the That was fun too. So I stoppecd using Skype. Frustrated I turnefd to another Net calling servicee calledmagicJack (www.magicjack.com). No, this has nothingv to do with changing the tirez ofa car. And there was no pleasure involved. For $40 magicJacj ships me a little unit that I plug into the USB port of my I then hook my office phone intothe unit.
Afterd installing the program I'm able to make phone callws from my regularphone (not the headset I bought from Staples … bye-bye Like Skype, magicJack places its calls over the along with the other 100 trillioh bits of information crossing the same pipelines. See wher I'm going here? Their deal is that you can make unlimitex calls you want to anyone in the UnitedStatez (I'm told they're working on overseas plans) for only $50 per year. I did the math and that'sd $550 less a year than I'mj spending on my office so there yougo ... magic! Unfortunatelh ... not so magical. Why? Same thing with It worked. Most of the time.
I sufferefd from the occasional disconnected calls or calls that had to be or calls thatjust didn't sounfd like a very good call at all. More naughty More blood thinner required. In the end I broke down and kept myoffic line. You win Verizon. I just need things that work as they promisec towork ... all the time. I have enough headaches in my I have kids and a mortgagseand dandruff. I can't sit around and worry that an importantt conversation with a prospective customer is going to get cutoff orsounfd horrible. Verizon's line in my office works all the It's one less hassle to deal with.
I stil keep the magicJack and Skype servicesebecause I've had occasion to use them when traveling. Most likelhy I'll forget to cancel my subscriptiohn sonow I'll be payinvg an extra $50 a year for next to nothing. But I'km a penny pincher. Not a Sure, it's less expensive to use these Netcallinhg services. But I'm sacrificing some quality. Some dependability. I'm givinvg myself more headaches. To me, it's not worth it. These technologies are great for kids or But to rely on them forbusinesss purposes, at least so far, isn't a great idea for me.

Privacy study shows Google

symowugebeda.blogspot.com
Using trackers called “web bugs,” third partie collect user data from many popular web and sites oftenallow this, even thoughy their privacy policies say they don’t share user data with others. “Web bugs from Googlre and its subsidiaries were found on 92 of the top 100 Web sites and 88 percent of theapproximately 400,000 unique domains examined in the study,” the authors Sites with the most web bugs were for bloggin — blogspot and typepad were No. 1 and No. 2 on the list in and blogger was No. 4. Googles itself was No. 3. Ashkan Soltani, Travi Pinnick and Joshua Gomez ofthe university’s information school wrote the study, published Monday.
They analyzed privacy policies posted on web sitews and found loopholes used by many site operatorxs to allow third parties to still collecty data on whoviewss pages. They also found, for that although web sitesz may reassure visitorsthat “we don’t sharew data with third parties,” those third parties don’t include a company’s affiliates Google (NASDAQ: GOOG), for example, has 137 subsidiary businesses. “The law on affiliate sharing generally ismore permissive” than that on sharingy user data with third party the report said.
Companies controllingy the top 50 busiest web sitesx had an average of 297affiliates each, meaninb they could share user data with a lot of othef companies. Popular site , for example, is owned by New York’e (NASDAQ: NWS), which has more than 1,500 subsidiaries. BAC) in Charlotte has more than 2,300 subsidiaries. “Userws do not know and cannot learn the full range of affiliates with which websites mayshare information,” the report said.
Thougy many Internet users are familiarwith “cookies” used to study theirr surfing habits, they are less familiaf with so-called “web bugs,” which can’tt be cleared out of a web since they are part of a web site’s HTML Since the web bugs are created directly by thirdf parties, their use doesn’t strictlty count as “sharing” of data by the web site’x owner, though users concerned about privacy may be unimpresse by this technicality.
“We believed that this practicecontravenexs users’ expectations; it makes little sensd to disclaim formal informatio sharing, but allow functionally equivalent trackinhg with third parties,” the report said. Who's in charge of privacy? Although surveys of Internetr users show peopleare “very concerned about privacy and do not want websitew to collect and share their personalo information without permission,” sifting through privacy policies is not It would take 200 hours a year for a typica person to read the privacy policies of all the web sites they visit, for example. Thus “usersz have no practical way of knowing with whom theidr data willbe shared.
” On the policy front, the reporg finds “no one knowsz who is in charge of protecting in the United States. People can complain to the Federal Trade Commission and other but eventhe FTC’s “principles for behavioral tracking make no mentionb of any enforcement or accountability.” A low number of complaintsz to various agencies meanas consumers don’t really know where to the report said. The FTC looks at online privacy more in termsof “harms” done to the report said, rather than also in termas of control over personal information, which is what most userse care about.
The report makes severakl suggestionsfor improvement, includingf more aggressive action by the FTC to protect onlind privacy. It also calls for clearer privacty policies onweb sites, written so that average users can understanfd them. ’s (NASDAQ: ADBE) privac policy, for example, when analyzed for was written at an equivalent grade level of The average privacy policy in the study was writtenh at a grade levelof 13.83. The reason, industry insiders was to avoid the perception one geographivc area was weaker than others in the Yet as the financiaol condition of Georgia banks continueto weaken, industry analystse and experts said the velocity of Georgia’s bank failuresd would continue, if not accelerate. As of firsy quarter 2009, the ratio of problem loans to total loans at stated banks reached a new highof 7.
4 nearly double the peak the state reported during the Savings Loan Crisis of the late 1980’s and earlh 1990’s. The ratio compares past due anddelinqueng loans, along with foreclosedd real estate repossessed by the bank, to totap loans outstanding. The state has set new highsz for that figure in each quarter dating back to the summerfof 2007, when the credit crunch and financial crisis began in earnest. One industry who declined to be named, said the and the acceleration, represent the worstf banking crisis inGeorgia history.
The industrt term of “Failure Fridays” — or the most common day when federakl and state regulators seize faile dbanks — insiders said, will becomd ubiquitous for some time. “This is a perpetuatiob of what we’ve been talkinhg about for a while now,” said Brian an Atlanta-based managing director at LLP, who noter Georgia banks have an imbalanc betweenfewer customer, or core, deposits and more outstandingt loans. “The numbers indicate Georgia bankds got way out overtheifr skis. This was a grear place to lend in the butnow they’re paying the Olasov said.
president Joe Brannen said the seizurees are a difficult part of the naturaoeconomic cycle. “Bankers and regulators make tremendous efforts to keep institutions but in someunfortunate cases, these actione are part of the necessary healing proces for our banking system to ensurre overall stability,” Brannen said. Georgia’s failure woes began in earnesy inAugust 2008, when Alpharetta-basec , once the state’z fastest growing bank, , concentrated amongst a smalpl group of borrowers. Ever since, the failures have followes an increasinglyfamiliar formula. Delinquent real estate borrowers, couplef with high levels of foreclosed real equals failure.
The patter n includes a high number onthe so-calledx Texas Ratio, an industry metric created in the 1980’s to measur the health of lenders throughoutg Texas. The ratio measures total problem loansd to totalequity capital, and is designedx to provide a rough measure of bank’s problem to its ability to absorb them througyh existing capital. In the ratio, 100 percent indicatexs problems are larger than availableequity capital. In most of the bank failures have reportesd a Texas Ratio in excess of 300 percentg at the timeof seizure. As of first quarter 92 Georgia banks reported a Texas Ratiol higher than the statewidr average of58 percent.
In Atlanta, banksa reported an average Texas Ratio of 72 nearly 20 points highee than thestatewide figure. Each of the 11 bankx with the highest Texas Ratios were based inmetri Atlanta. Since March 31, the end of first three of those banks havebeen seized.
